Terms & Conditions for the purchase of the Online Course

 

By accepting these terms, a binding agreement shall arise between you (Student) and Aphrodites Makeup Artist. (AMUA)

 

By accepting these terms, you agree to pay the course fee ('Course Fee') for the course you have selected under this Student Agreement ('Course'). Upon receipt of the Course Fee, AMUA agrees to:

 

1. Supply you with all modules and assignments for your Course ('Course Materials');

 

2. Allocate a tutor to you at the time of enrolment. This tutor will be your contact and will remain your tutor while you are a student at AMUA. If your tutor is absent during this time, a substitute tutor will always be available.

 

3. Mark and grade your worksheets (if any);

 

4. Answer queries about your Course;

 

5. Issue a Certificate upon successfully completing all worksheets.

 

COURSE MATERIAL

 

The Course Fee does not cover any materials that are not listed as Course Materials for your Course. AMUA notes that you may need to provide your own equipment in addition to the Course Materials at your cost, i.e. Makeup Kit. Subject to successful completion of all worksheets and the Course Fee being paid in full, AMUA will issue you a Certificate for your Course.

 

Course Materials may be available to you as you progress through the Course and submit your worksheets. AMUA reserves the right to withhold provision of Course Materials in the event that you fail to pay any part of the Course Fee as and when it becomes payable.

 

The content of the Course Materials, including copyright and all other such intellectual property rights contained therein, remain the property of AMUA, or a nominated third party. You may not reproduce any part of the Course Materials without the prior written consent of AMUA.

 

You are not to copy or download any of the videos made available to you to facilitate your learning as these resources remain the property of AMUA, or a nominated third party and are only able to be streamed through the resources provided by AMUA.

 

The course can be completed in 4 weeks but if more time and attention is needed AMUA reserves the right to charge a fee for extensions.

 

COMPANY OBLIGATIONS

 

AMUA will use commercially reasonable efforts to enable the Services to be accessible, except for scheduled maintenance and required repairs, and except for any interruption due to causes beyond the reasonable control of, or not reasonably foreseeable by AMUA, including, but not limited to, any Force Majeure Event (as defined below). The foregoing undertaking shall not apply to the extent of any non-conformance caused by use of the Services contrary to AMUA’s instructions, or modification or alteration of the Services by any party other than AMUA. If the Services are in non-conformance with the foregoing undertaking, AMUA will, at its expense, use all reasonable commercial endeavors to correct any such non-conformance promptly, or provide the Student with an alternative means of accomplishing the desired performance.

 

ENROLMENT COURSE FEES & REFUNDS

All Aphro Blending 4 weeks course are non refundable. Due to the instant accessible features of the content the Online Distance Regulations would apply. 

 

As per Online Distance Selling Regulations by using a streaming service, via an app or website you automatically lose the 14 day right to cancel.

 

Balances of the full courses fee should be paid no later than 21 days to AMUA prior to the commencement date. Failure to pay the balance by the due date will result in the deposit being forfeited and no entitlement to a new date.

 

Once notification of the commencement date has been issued there will be no opportunity to change the course date without the full payment of any outstanding balance. AMUA reserves the right to change and confirm another course start date. (This will be subject to availability only). The applicant can make only one change of date.

 

All fees must be received by AMUA  in full and any overseas or UK bank charges will automatically be added to the final balance payable. Courses are not exempt from VAT nor can VAT be claimed back by overseas students. All fees quoted attract and include VAT (UK GOVERNMENT TAX) at the current rate with no exemptions.

 

Students will not be accepted on the commencement date unless full payment of fees has been received by AMUA.

 

Course fees, deposits and other payments are non-transferable.

 

The Course is not transferable to another person.

 

SUBSCRIPTION MONHTLY MEMBERS ONLY

The Student agrees to pay the appropriate fee corresponding to the particular Services that it wishes to access for the applicable Subscription Term ( “ Subscription Fee ” ). AMUA reserves the right to change the Subscription Fee with respect to a Renewal Term with prior written notification. Unless otherwise expressly stated, all fees are non-cancellable and non-refundable.

 

Recurring charges are billed in advance of service. The Student agrees to provide AMUA with valid, up-to-date and complete debit/credit card, contact and billing details. The Student further authorises AMUA to bill such debit/Fcredit card on the Effective Date (and corresponding Renewal Dates, if appropriate) for the Subscription Fee due for the Subscription Term (and Renewal Term). 

 

If, for any reason, the Student’s credit/debit card company refuses to pay the amount billed for the Services, the Student agrees AMUA may, at its option, suspend or terminate Students subscription to the Services and require the Student to pay the overdue amount by other means acceptable to AMUA. 

 

Subject to these Terms of Service, the Student will be granted a limited, non-exclusive, revocable, non-transferable, and non-sublicensable right to access that portion of the Subscription Website/APP applicable to the Subscription type. AMUA may upgrade, modify, change or enhance the Services and convert a Student to a new version thereof at any time in its sole discretion, to the extent that this is not detrimental to Student’s use of the Services and on reasonable prior notice to the Student  (unless the change is of critical business importance or outside the AMUA’s control, in which case AMUA  will explain the reason for the changes as soon as is reasonably practicable).

 

The Student agrees to abide by any rules or regulations that AMUA publishes with respect to conduct of Student and other users of the Website/App, which rules and regulations are hereby incorporated into these Terms of Service by this reference. AMUA reserves the right to deny a Student and/or an Authorised End User access to the Subscription Website/App if, in the AMUAS sole discretion, Student and/or Authorised End User has failed to abide by these Terms of Service or appear likely to do so.

                                                                                                                                                    

Access privileges may not be transferred to any third-parties;

It will not access, store, distribute or transmit any Viruses;

It will comply with all applicable laws and regulations with respect to use of the Services;

It will not rent, lease, sublicense, re-sell, distribute, transfer, copy or modify the Services or any component thereof;

It will not translate, decompile, or create or attempt to create, by reverse engineering or otherwise, the source code from the object code made available hereunder;

It will not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit the Services or any portion thereof;

It will not delete or alter any copyright, trademark or other proprietary rights notices from copies of materials from the Website or contained in the Services;

It is solely responsible for acquiring, installing, operating and maintaining the hardware and software environment, network connections, and telecommunication links, necessary to access and use the Services;

It will not use the Services in any manner, or in connection with any content, data, hardware, software or other materials that infringes upon or violates any patent, copyright, trade secret, trademark, or other intellectual property right of any third party, or that constitutes a defamation, libel, invasion of privacy, or violation of any right of publicity or other third party right, or that is threatening, harassing or malicious.

 

TERMINATION OF MONTHLY SUBSCRIPTION

The Student may subscribe to the Services for the applicable term of the specific Subscription commencing on the Effective Date ( “ Initial Term ” ). Thereafter, the Subscription will renew automatically on the corresponding anniversary date ( “Renewal Date ” ) of the Effective Date (each a “ Renewal Term ” , and collectively with the Initial Term, the “ Subscription Term ” ), until the Student notifies AMUA of its intention not to renew prior to the end of the then-current term.

 

AMUA reserves the right to terminate or suspend access to all or any portion of the Services for violation or suspected violation of these Terms of Service.

 

The Effect of Termination means the Student  will have no further rights to access the Subscription Website. Or App Termination will not affect the rights or liabilities of either party that accrued prior to termination.

 

In addition to any other rights under these Terms of Service, you may cancel any Subscription for any reason by emailing  mandy@aphroditesmua.co.uk . As per Online distance Selling Regulations by using a streaming service, via an app or website you automatically lose the 14 day right to cancel.

 

CHANGES

Except, for any provisions determining the primary contractual obligations of the Student and AMUA hereunder, AMUA has the right to revise and amend these Terms of Service from time to time to reflect changes in business needs including, but not limited to, changes in features and functionality, changes in market conditions, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in system capabilities. Changes are effective immediately upon posting the Student’s continued use of any of the Services following the posting of revised Terms of Service means that the Student accepts and agrees to the changes, to the extent permitted by applicable laws.

 

CONFIDENTIALITY

The Student agrees to maintain the confidentiality of the AMUA Confidential Information. For the purposes of these Terms of Service, the term “Confidential Information” means all portions of the Services, including but not limited to, the Subscription Website/App.


 

COPYRIGHT/ INTELLECTUAL PROPERTY

Unless expressly stated otherwise, AMUA claims copyright ownership of all material on the course website and App. You must not download, display, print and reproduce this material in unaltered form for your personal, non-commercial use.

 

AMUA reserves the right to revoke such permission at any time. Apart from this permission and uses permitted under the Copyright Act 1968, all other rights are reserved.

 

Requests for further authorisations, including authorisations to use material on this website for commercial purposes, should be directed to our staff via the Contact Us form.

 

No right, title or interest in or to the Services or any portion thereof, is transferred to any Student or authorised end user and all rights not expressly granted herein, are reserved by AMUA.

 

The Company name, the Company logo, and all related names, logos, product and service names, designs and slogans, are trademarks of AMUA or its affiliates or licensors. The Student may not use such marks without the prior written permission of AMUA. All other names, logos, product and service names, designs and slogans on this Website are the trademarks of their respective owners.

 

FORCE MAJEURE 

AMUA will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations that is caused by events outside its reasonable control ( “ Force Majeure Event ” ). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond AMUA reasonable control including, but not limited to, restrictions of law, regulations, orders, or other governmental directives, pandemics, labor disputes, acts of God, third party mechanical or other equipment breakdowns, terrorist attacks, fire, explosions, fibre optic cable cuts, interruption or failure of telecommunications or digital transmission links, Internet failures or delays, storms or other similar events.
